January 11, 2011 Members Present: Joseph Krolick, Vice President, Councilman: Mike Paulina, Councilman, John Hughmanic, Councilman Louis Tate, Councilman Vernon Felton, Councilman John Buterbaugh, Dennis Clawson, Manager Rob Barto, Chief Joe Douglas Member Excused Absence – James Marsh, President Vice President Joseph Krolick called the meeting to order at 7:00 pm and conducted the Pledge of Allegiance, followed by a moment of silence for the victims of the tragedy in Arizona. Approval of the Agenda: A motion to approve the Agenda was made by Councilman Felton, seconded by Councilman Hughmanic Motion passed unanimously. 6-0 Minutes of the Previous Meeting: A motion was made by Councilman Hughmanic, seconded by Councilman Felton to approve the minutes of the previous meeting. Motion passed unanimously 6-0. Approval of Fund Balance Report: A motion was made by Councilman Buterbaugh, seconded by Councilman Hughmanic to approve the Fund Balance Report. Motion passed roll call vote unanimously 6-0. Presentation of Bills: A motion was made by Councilman Buterbaugh and seconded by Councilman Felton to authorize payment of bills. Roll call vote passed unanimously 6-0. Public Participation: PJ Simpson presented a petition signed by 18 residents that live on the 500 block of Morris Street. The petition is in response to the December council meeting in which a motion was passed to restrict parking on the 500 block of Morris Street. The residents feel that if this block is to be restricted that all of Morris Street should be restricted. Council decided at December's meeting to restrict this area due to the difficulty in plowing that street last winter and to make it easier for emergency vehicles to pass. Council will reconsider its motion at the February meeting. In the meantime they will not enforce restricted parking in this area. Mayor's & Police reports – Mayor Clawson read the Parking revenue summary for January. Chief Douglas read his monthly report. A motion to accept the Mayors Report and the Police Report was made by Councilman Paulina and seconded by Councilman Tate. Motion passed unanimously 6-0 Manager’s Report: Rob Barto Manager Dawson Geophysical's survey was approved by council's solicitor. The only comment by the solicitor was to be certain that Dawson has liability insurance, which was confirmed by certificate. The agreement was signed and sent to Dawson. President James Marsh will have surgery in February, 2011. We are all wishing him a speedy recovery. Old Business: nothing to report
COMMITTEE REPORTS
Finance Committee – John Buterbaugh, Chairman Councilman Buterbaugh reported that the 2011 budget was finalized at the end of 2010. Councilman Buterbaugh read the year end report for the 2010 budget. It is available from Manager Barto if anyone wants to review a copy. Municipal Committee: - Vernon Felton, Chairman Ratify Volunteer Fire Department 2011 officers. Councilman Felton ask council to ratify the election 2011 officers for the Clymer Volunteer Fire Department. Elected and Appointed positions were read by Councilman Felton. Motion was made by Councilman Felton to ratify the new officers as read, motion was seconded by Councilman Paulina. Motion passed roll call vote 6-0. Police Committee: - Joseph Krolick, Chairman nothing to report Property Committee: - Louis Tate, Chairman Councilman Tate ask that a warning be put in the newspaper to all Clymer resident, including those in rental properties that Borough ordinances require that sidewalks be cleared of snow within 24 hours of the end of snowfall. Fines will be assessed for walks not shoveled Parks and Recreation Committee: - John Hughmanic, Chairman Manager Barto stated that at the January 25th committee meeting a presentation will be made to council for the Parks Master Plan. Council can then make a decision as to whether they want to pursue this master plan for the development of our parks. Mayor Clawson addressed council as a private citizen. Clymer Days committee would like to install additional lighting and replace the current 100 AMP service at Sherman Street Park at no cost to the Borough. Private citizen Clawson also requested the use of Sherman Street park in September for the annual Clymer Days Festival. Motion to accept the gift of lighting and new 100 AMP service from Clymer Days Committee and to also grant the Clymer Day's Committee the use of Sherman Street Park for the annual Clymer Days Festival to be held in September 23, 24 & 25, 2011 was made by Councilman Hughmanic and seconded by Councilman Tate. The motion passed roll call vote unanimously 6-0. Street Committee: Mike Paulina, Chairman Councilman Paulina had nothing to report. Councilman Hughmanic reported that the stop sign at the corner of Franklin Street and Cherry Avenue is missing. Chief Douglas reported that it is a state sign and he had contacted the state a while ago. Councilman Paullina ask Asst. Secretary, Shirley Simpson to call and report the missing sign. Sign project was discussed. Signs are on order, Manager Barto passed around pictures of new signs. Posts are already in our stock. They are square breakaway type posts. Street light problems were also discussed, Manager Barto will call Penelec and talk to them about the problem. Motion passed unanimously 5-0. Approval of Fund Balance Report: A motion was made by Councilman Felton, seconded by Councilman Tate to approve the Fund Balance Report. Motion passed roll call vote unanimously 5-0. Presentation of Bills: Councilman Paulina questioned the decision to not take out a Tax Anticipation loan for 2011. Manager Barto explained that a loan would require passing an ordinance and the accompanying paperwork plus legal fees to the solicitor along with paying interest on the loan. Manager Barto stated, that taking the money out of the reserve fund, which has not been collecting much interest, would save the borough approximately $1200. Manager Barto stated the money will be returned to the Reserve Fund, as the 2011 tax dollars are received. Mayor Clawson agreed with borrowing from the Reserve fund and stated he felt it was smart management. Councilman Paulina also questioned why we withdrew approximately $5000 from the Sanitation Fund. Manager Barto explained that the money withdrawn was to pay for our spring and fall cleanup in 2010. Manager Barto stated that with our new garbage contract we will no longer have to pay for these cleanups, they are covered under the contract as a service. A motion was made by Councilman Tate and seconded by Councilman Felton to authorize payment of bills. Roll call vote passed unanimously 5-0. Public Participation: None Mayor's & Police reports – Mayor Clawson read this monthly summary report. Total collected over one month period for parking meters, State Police fines, Magistrate Fines and Park fines was $1590.14 Mayor Clawson and Manager Barto attended Indiana County Outreach Program at Penn dot on January 28, 2011. The meeting was informative; the first thing they talked about was our bridge work that is to resume in March with a completion date of November 2011. Mayor Clawson also met with John Serian, Indiana County Maintenance Manager concerning the plowing of Routes 403 and 286. Mayor Clawson asks if they could possibly slow their trucks down and avoid pushing so much snow onto sidewalks and bridge decks. Mr. Serian agreed to talk to his plow workers. Chief Douglas also read his monthly report Motion was made by Councilman Tate and seconded by Councilman Hughmanic to accept the Mayor’s Report and the Police Chief’s report as read. Motion passed unanimously 5-0 Manager’s Report: Rob Barto Manager Nothing to report Old Business: Dawson Engineering has started to set flags for the survey project. Project should begin in a few weeks. COMMITTEE REPORTS Finance Committee – John Buterbaugh, Chairman, absent Dan Berkey, Tax Collector was given the floor. Mr. Berkey told the council the Borough had a 92.8 percent collection rate on real estate taxes for 2010, but just a 58.7 percent rate on per capita taxes. The per capita is calculated on separate bills making the percentage much lower. Indiana County is late in getting the tax information out for 2011, which may in turn make the notices late in going out. Also the format of the notices has changed because of the new software program. Mr. Berkey has changed his office hours for 2011 they are 3:30 to 6:30 on Mondays and 1:30 to 4:00 on Thursday or by appointment. Municipal Committee: - Vernon Felton, Chairman Nothing to report Police Committee: - Joseph Krolick, Chairman nothing to report Property Committee: - Louis Tate, Chairman Councilman Tate reminded residents to keep their sidewalks shoveled and commended the borough employees for their efforts keeping Clymer Streets plowed. Parks and Recreation Committee: - John Hughmanic, Chairman Nothing to report Street Committee: Mike Paulina, Chairman Councilman Paulina had nothing to report. Manager Barto reported that he talked to Penelec regarding our Street Light problems. They requested that we FAX our problem reports to two different facilities so they can be expedited. Chief Douglas will get the numbers off poles in question tomorrow and they will be reported. Chief Douglas had nothing new to report Manager’s Report: Rob Barto Manager Website – Manager Barto and Asst Secretary Simpson met with Jerry Hetrick, the Borough’s website coordinator. He is going to be updating the website. Manager Barto asked all the Councilman and Mayor to write a small history of themselves to be posted on the website and turned in at the next meeting. Manager Barto stated that the ordinances will soon be added to the website so the general public can look up and print any ordinance. Presentation to Indiana County Commissioners- Manager Barto is making a power point presentation to the Indiana County Commissioners on March 9th outlining the Borough’s current projects; Park Memorial, Land Use Control, Municipal Authority Project Partnering with Indiana County, and Park Development Project. This effort is being made in order to keep the Commissioners aware of what Clymer is working on. Old Business: nothing to report COMMITTEE REPORTS Finance Committee – John Buterbaugh, Chairman Nothing to report Municipal Committee: - Vernon Felton, Chairman Spring clean up will be from May 2nd to May 7th. From 9 AM to 3 PM. It is part of the Borough’s contract with Waste Management so there will be no charge to the Borough this year. Street Sweeping will be on April 11th. Resident must clean their sidewalks by April 9th. Police Committee: - Joseph Krolick, Chairman Nothing to report Property Committee: - Louis Tate, Chairman Councilman Paulina reported that there is an issue in Sample Run with a drain that runs through a property belonging to a homeowner, who wants the drain removed so that he can erect a building. Councilman Paulina agreed to move the drain sometime this spring or summer. Parks and Recreation Committee: - John Hughmanic, Chairman Councilman Hughmanic reported that there needs to be an inspection of the Parks before an opening date is set. The Inspection date was set for Tuesday, March 15th. Councilman Hughmanic, Manager Barto and Jody Pearce of Maintenance will perform the inspection. Street Committee: Mike Paulina, Chairman Councilman Krolick feels that the streets are not holding up. Councilman Krolick asked Manager Barto to check the warranty on the coating. Councilman Paulina got a complaint about the shoulder in front of Charlie Cox’s house, Manager Barto said he looked at it last fall and will reevaluate it next week. Manager Barto said when he last looked at it, that it looked to him like someone had damaged the pavement. Joseph Douglas asked Council to give up ownership of part of Sage Street that exists only on paper. Douglas is planning to build on his property and he cannot put a driveway and utilities to that home without use of the Sage Street right of way. Both issues were sent to Committee Meeting on March 22nd. Correspondence/Conferences/Meetings: Secretary Simpson announced that the Spring Meeting for the Indiana County Borough's Association will be held on March 16th. Simpson requested that anyone that is planning on attending must notify her by March 11th. Public Participation: Deborah & Ron Wenzel live near Sherman Street Park. They ask council to put a net behind home plate to catch the balls that are coming into their yard, and in some cases hitting their home and causing damage. Council will look into the problem and see what they can do to remedy the situation.. Mayor's & Police reports – Mayor Clawson read the Parking revenue summary for April. Mayor Clawson also reported that he attended the ribbon cutting at the new Home Nursing Facility on Franklin Street and complimented them on their facility. Chief Douglas read the police report for April. Motion was made by Councilman Tate and seconded by Councilman Hughmanic to accept the Mayor's and Police report as read. Motion passed 5-0 Manager’s Report: Rob Barto Manager Manager Barto reported that he met with the DCED in Pittsburgh to discuss funding to help the borough look into changing their zoning codes to “formed based” codes. Manager Barto said that the DCED had a positive reaction to the plan and that he plans to apply for funding this July. Manager Barto also reported that the sign project is approximately 2/3 complete. After the streets signs are complete we will take a look at what other signs are still needed. At the present we have $11,000 left in the fund. Old Business: Councilman Hughmanic reported that the stop sign at the corner of Franklin Street and Cherry Avenue has not been replaced. The Assistant Secretary called them in January and she will call them again tomorrow. COMMITTEE REPORTS
Finance Committee – John Buterbaugh, Chairman, absent (Manager Barto reported ) Manager Barto passed out a copy of the 2010 Audit report. Manager Barto reported that there were two minor issues this year. The first issues deals with how Manager Barto tracks the money spent on projects in the reserve fund. Manager Barto has made the suggested change so that the project tracking is easier to follow. The second issue will necessitate a formal policy change. The change will require at least one of the check signatures to be physical rather than a stamped signature. A stamped signature will require a written authorization . Council will vote on the policy change at the next meeting. Policy 01-11. Municipal Committee: - Vernon Felton, Chairman Nothing to report Police Committee: - Joseph Krolick, Chairman Vice President Krolick stated because of safety concerns, the senior bus should be parked behind the Senior Center, after unloading and not be parked out front all day. The issue was deferred to committee for discussion and investigation. Property Committee: - Louis Tate, Chairman Councilman Paulina made a motion to advertise an ordinance to vacate a portion of Sage Street and make the requesting property owner be responsible for all costs associated with the ordinance. Motion was seconded by Councilman Tate. Motion passed roll call vote 5-0 Parks and Recreation Committee: - John Hughmanic, Chairman The Flagpole and Memorial Project at the Sherman Street Ballpark has raised at total of $5202 to date. It is $100 short of the goal. The Memorial will be 10 X 10 and will be at the creek bank between the small pavilion and the outfield fence. The last day to order memorial bricks is May 15, 2011. Street Committee: Mike Paulina, Chairman Spring Clean Up – Is from 5-3 to 5-7 from 9 to 3:30. Street Cleanup – Residents have not swept sidewalks as requested, so Borough Maintenance is running behind on this project. Councilman Tate will pay a couple of his busboys to help sweep the sidewalks on Franklin Street. Maintenance will begin sweeping on April 18th. Motion was made by Councilman Paulina to allow The Church of the Resurrection to close Third Street from Morris Street to Hancock Street on Saturday April 23, 2011 from 8 PM to midnight. Motion was seconded by Councilman Hughmanic. Public Participation: No Public Participation Mayor's & Police reports – Mayor Clawson read the Summary of Revenue for the month of May. Mayor Clawson also told council a Memorial Day celebration will be at 11 AM, May 30 in front of the American Legion. Chief Douglas read the Police report. Manager’s Report: Rob Barto Manager, absent Councilman Paulina reported that most of the new signs are in place. As maintenance has time they will complete the project. Old Business: Councilman Hughmanic and Mayor Clawson mentioned that since the last committee meeting was canceled, there was no decision made on how to install a net at the ball field to prevent balls from hitting the home adjacent to the field, as discussed in the last council meeting. This subject was again referred to committee for resolution. COMMITTEE REPORTS Finance Committee – John Buterbaugh, Chairman Audit and Signature Policy - Motion was made by Councilman Buterbaugh and seconded by Councilman Hughmanic to put in place the Purchasing and Signature Policy #02-07, as presented to council. Motion passed roll call vote 6-0. Municipal Committee: - Vernon Felton, Chairman Nothing to report Police Committee: - Joseph Krolick, Chairman Chief Douglas reported that Clymer Borough Police partnered with Indiana County Sheriff's Office and Indiana Borough Police to get a grant for equipment. The grant should be approved in the near future. The police department will be able to purchase Camera Systems for the patrol cars with this grant money. Property Committee: - Louis Tate, Chairman Councilman Tate asked for more police presence on the weekends to keep the kids out of the park areas after sunset due to current vandalism. Councilman Tate also pointed out that the contractor who is replacing the bridge is dumping debris in the ravine with the Borough’s permission, but as the ravine fills, water is collecting and will become a mosquito breeding ground. Council needs to address the situation and possibly install drain pipes in the near future. Motion was made by Councilman Paulina and seconded by Councilman Tate to Adopt Ordinance #335 Vacating a Portion of Sage Street. Motion passed roll call vote 6-0. Motion was made by Councilman Tate and seconded by Councilman Hughmanic to purchase Lots #77 and 79 on Adams Street for $2000. Motion passed roll call vote 6-0. Parks and Recreation Committee: - John Hughmanic, Chairman The flagpole for the Memorial Patio was delivered this week. May 15th is the deadline for purchasing bricks for the Memorial patio. Street Committee: Mike Paulina, Chairman Spring Cleanup is complete. Street Sweeping – Maintenance will complete the job of sweeping the streets as time allows. Councilman Paulina asked council for approval to purchase 5000 gal of tar to tar and chip all the avenues in the Borough. Motion was made by Councilman Tate and seconded by Councilman Paulina to purchase the necessary tar. Motion passed roll call vote 6-0. Correspondence/Conferences/Meetings: Asst Secretary read an invitation to Indiana Tourist Bureau dinner to be held on June 22, 2011. Public Participation: David McCoy of the Christian Missionary Alliance Church asked for permission to put up three “reserved parking” signs in front of the church on Sundays from 9 AM to 1 PM. The Borough will not be responsible for enforcing the parking in these spaces. Councilman Paulina made a motion to grant permission, motion was seconded by Councilman Hughmanic. Motion passed 5-0. David Mc Coy also stated that the church wants to extend the roof over the handicapped ramp; he was referred to Indiana County Planning and Development for permits. David McCoy also asked about the procedure for putting in loading and unloading gravel area behind the church. David was told the procedure by Manager Barto. Architect Mike Nowak asked the board to vacate the alley between properties located at 370 Hancock Street and 360 Hancock Street. This right of way has not been opened or used in the previous 25 years. Both residents Frank Fornari and Phillip Mack are in favor of the plan. The issue was referred to committee. Sadie Lewis asked the board to consider either granting her an exception or changing the current ordinance to allow her to keep six chickens at her residence at 190 Jefferson Street. Mayor Clawson also reported that grant money that was received from a grant applied for in conjunction with the County Sheriffs office, Indiana Borough and Clymer Borough. The grant, for cameras for the police cruisers was received and the cameras have been installed in both cruisers. Chief Douglas read the Police report for the month. Motion was made by Councilman Felton and seconded by Councilman Paulina to have the community yard sale on July 2,3 & 4th. Motion passed unanimously 5-0. Fireman's Carnival/Parade- Councilman Felton made a motion to allow the fireman's carnival on Sherman Street from June 20 through June 25th with a parade on June 25th at 11 AM, to also allow alcohol to be consumed on the fire company's property, to allow campers to park at the Lee Street park and to allow fireworks the evening of June 25th. The motion was seconded by Councilman Tate Motion passed unanimously 5-0. Career Track notified Councilman Paulina that they will not have any help available for this summer for the Borough. Motion passed unanimously 6-0. Minutes of the Previous Meeting: A motion was made by Councilman Tate and seconded by Councilman Felton to approve the minutes of the previous meeting. Motion passed unanimously 6-0. Approval of Fund Balance Report: Manager Barto reviewed the Fund Balance Report and passed out a Balance Sheet that he also reviewed in detail. Manager Barto will include a copy of the Borough's current Balance Sheet in meeting packets in the future. Presentation of Bills: Manager Barto advised council that the $62,447.17 check to Marion Center Bank is the third payment of ten on the General Obligation Note of 2008. Monies in the amount of $40,800 were transferred from the Liquid Fuels Fund on July 11, 2011 to the General Fund for the purpose of payment of this bill. A motion was made by Councilman Paulina and seconded by Councilman Tate to authorize payment of bills. Motion passed roll call vote unanimously 6-0. Public Participation: Judith and Bill Greene who are organizing “Son Day in the Park” event for August 14th will be having a fund raising car wash, bake sale and basket raffle on July 16th at the Bill Greene Car business on Franklin Street. Finance Committee – John Buterbaugh, Chairman Manager Barto and staff will begin working on the 2012 budget in August.
Municipal Committee: - Vernon Felton, Chairman Waste Management is working with Clymer Borough to adopted a new pilot project for recycling. In an effort to encourage residents to recycle, a drop off box will be put at the Adam Street garage. All recyclables including glass, plastics, cardboard, newspapers and cans will be accepted and the residents will not have to divide the items according to type. The project is currently in the planning stage. Clymer Borough and the County will receive credit for recyclables under this proposed project. The Borough will have to pay Waste Management a nominal fee for removal and hauling of the boxes. Councilman Felton proposed to amended Ordinance #327 that covers fines imposed for failing to pay garbage fees. Motion was made by Councilman Felton and seconded by Councilman Tate to allow Manager Barto to advertise Ordinance 336 changing the fee schedule to not less than $50 nor more than $600 for non-payment. Police Committee: - Joseph Krolick, Chairman Councilman Tate asked that new uniforms be ordered to replace some of the worn police outfits. Chef Douglas stated that they have already been ordered. Property Committee: - Louis Tate, Chairman Request to vacate a portion of Tulip Ave – Councilman Paulina stated that he thinks the requester actually means Pine Ave. After verification it was determined to be Pine Avenue. Councilman Tate requested a little more time to look over the situation and talk to the requester to get more details. If the requester wants the Borough to abandon the alley the request will be sent to Committee for further discussion. Parks and Recreation Committee: - John Hughmanic, Chairman Manager Barto told Council that the work on the Memorial Project at the park should be completed at the end of the summer and so far donations have outpaced estimated expenses. Mayor Clawson reported that work to install lights at Sherman Street Park is under way. He also said he is working to find funding and volunteers to help repair the pavilion roof and install lights on the score board. Councilman Hughmanic would like to have a water fountain installed on the Sample Run trail for next summer. Street Committee: Mike Paulina, Chairman Brake Retarder Ordinance - The Traffic Unit of Penndot completed the Engineering and Traffic Study and indicates that an engine brake retarder restriction is warranted per their letter dated June 30, 2011. A Motion was made by Councilman Paulina and seconded by Councilman Hughmanic to authorize Manager Barto to work with the Borough's solicitor to create an Ordinance to prohibit the use of Brake Retarders on SR 286 from Cherryhill Township Line and SR 403 and throughout Clymer Borough. Motion passed roll call vote 6-0. Councilman Paulina reported to council that tar and chipping on the borough alleys will begin the week of July 18, 2011. Councilman Paulina also thanked Green Township for sending two trucks and staff to help with the project. Councilman Paulina reported to council that Clymer Rental is having an auction and several items would be beneficial to the Borough Maintenance Department. Public Participation: Joseph Mravouich stated that he was asked by Chief Douglas to remove a large rock he put next to his sidewalk to prevent truck traffic from Oak Avenue breaking up his sidewalk and damaging his property. Mr. Mravouich asked council to allow him to keep this rock on the property. The issue was referred to committee. Council will take a look at the situation. Sadie Lewis presented to council a petition of 109 signatures from Clymer residents open to allowing chickens in their neighborhoods. Manager Barto said that the current ordinance falls under zoning regulations and he hopes the property committee will be working on zoning plans shortly and can consider the change at that time. Manager Barto said he recommended against changing property related ordinances piecemeal and that the request had originally been sent to committee to be looked at during zoning discussions. The issue was sent to committee for further review. Mayors & Police Reports: Councilman Paulina read the Mayors Report. Chief Douglas stated that the report was not available at this time. Manager’s Report: Rob Barto Manager Sherman Street Park Memorial Project is nearing completion. Flagpole is up, plaques should be mounted by the end of the week. Form Base Codes. Manager Barto spoke to the representation of DECD last week and he inform Manager Barto that there is a pool of money for municipal planning that will be available. The representative that Manager Barto met with in April stated that he liked what the Borough is planning and the Borough is qualified for grant money. Grant applications will be available late August or early September and the Borough will be submitting for grant money at that time.
