Clymer Borough Council January 12, 2010 Members Present: James Marsh, Joe Krolick, , Mike Paulina, Louis Tate, John Hughmanic, Vernon Felton, Mayor Dennis Clawson, Manager Rob Barto and Chief Joe Douglas Members Absent – John Buterbaugh President James Marsh called the meeting to order at 7:00 pm and conducted the Pledge of Allegiance, followed by a moment of silence. Approval of the Agenda: A motion to approve the Agenda was made by Councilman Krolick, seconded by Councilman Hughmanic. Motion passed unanimously. 6-0 Minutes of the Previous Meeting: A motion was made by Councilman Krolick, seconded by Councilman Hughmanic to approve the minutes of the previous meeting. Motion passed unanimously. 6-0 Approval of Fund Balance Report: A motion was made by Councilman Krolick, seconded by Councilman Hughmanic to approve the Fund Balance Report. Motion passed unanimously. 6-0 Presentation of Bills: A motion was made by Councilman Krolick and seconded by Councilman Tate to authorize payment of bills. Motion passed unanimously 6-0. Public Participation: none Mayor’s Report and Police Report: Mayor Clawson read his report. Chief Douglas read the police report. Mayor Clawson presented other business: Residents need to be aware that sidewalks need to be cleared of snow or citations may be issued. Residents need to refrain from parking in front of access steps to other resident’s homes. Mayor Clawson attended Dave Reed’s Town Meeting last month. Subjects discussed were: New 911 System, Consolidation of School Districts, Sewage Projects, Lucerne Area water Problems, Marcellus Drilling needs a vast amount of water and drug problems. Motion was made by Councilman Krolick and seconded by Councilman Tate to accept reports as read. Motion passed 6-0 Manager’s Report Manger Barto gave a year end budget report for 2009. The Borough finished the year with an operating surplus of $5000. He announced he will be working on four major projects in 2010
Gave an update on the Emergency Management leadership transition from Fred Catchpole to Bill Cochran. Motion was made by Councilman Krolick and seconded by Councilman Tate to accept the Manager’s report. Motion passed 6-0. Old Business: Recycling Project – Manager Barto reported that area businesses are taking advantage of recycling, residents are not. COMMITTEE REPORTS
Finance Committee – Nothing to report Municipal Committee: - Vernon Felton, Chairman Councilman Paulina brought up the fact that the garbage bills are due on the 10th of the month and the water bills are due on the 20th of the month. If we changed the due date on garbage bills to the 20th and charge a late fee after 30 days it would work better for the residents. This subject was sent to committee for more investigation. Police Committee: - Joseph Krolick, Chairman Nothing to report Property Committee: Chairman Louis Tate, Chairman Ruth Abraham Braughler gifted three Sixth Street lots to the Borough. Manager Barto is working with Braughler’s attorney to clarify the location of the lots. Motion was made by Councilman Hughmanic and seconded by Councilman Krolick to accept the gift. Motion passed 6-0 Parks and Recreation Committee: - John Hughmanic, Chairman Nothing to report Street Committee: Mike Paulina, Chairman Street Chair Paulina commented that street worker Jody Pearce is doing an excellent job of clearing snow from the streets. Councilman Tate reported that Joe Dolan’s renter wants to park on 6th Street to have easy access to her car. Sixth Street parking will be investigated by Chief Douglas. . Public Participation: Several residents of Dixon Road in Sample Run complained about trash removal on their street. Without knowledge or approval of the Borough, Waste Management changed the front street collection policy in their neighborhood sometime during 2009 and began collecting garbage on the alley in back of their residences known as Willow Ave. When the Borough found out about the exceptions, Waste Management was instructed to no longer pick up on Willow Avenue (alley behind Dixon Road). Dixon Road residents are also experiencing a drainage problem at the rear of their properties along Willow Avenue. The borough will look into this problem as soon as the weather breaks. Another resident is experiencing a problem with accessing her property on Sage Street. The matter was referred to Chief Douglas and Mayor Dennis Clawson. Mayor’s Report and Police Report: Mayor's report was presented by Dennis Clawson. State of Emergency was declared in Clymer on Saturday February 6. John Gromley, Deputy Emergency Coordinator was given authority to take charge of the snow clean up. Mayor Clawson praised the borough employees and the emergency management team and road crews for keeping the streets clear during the storm. Mayor Clawson also wanted to remind residents to remove snow from sidewalks. Motion was made by Councilman Krolick and seconded by Councilman John Hughmanic to accept the Mayors report. Motion passed 6-0 Manager’s Report: Manager Barto is keeping tabs on the money spent on the snow emergency clean up. Old Business: None

Public Participation: Several residents and council members thanked the road crews for their snow removal efforts. A Children's Day Care Owner/Resident of 3rd and Sherman Street requested that something be done about speeding motorist running stop signs in that area. There have been several near misses involving children in the last couple weeks. Council will investigate “Watch Children Signs” and “Speed Calming Devices” and have the police patrol that area as much as possible. A resident of Dixon Road ask council to put guard rails along his property because of speeding motorist. Councilman Paulina, Mayor Clawson and Jody Pearce will set up a time that they can go to that area and investigate the problem. Tax Collector Dan Berkey raised concerns that Clymer's mailing lists for per capita taxes are out of date. He sent out over 900 bills and received 185 back as undeliverable. The returned bills represent approximately $3000 in tax revenue. He ask council, if they thought we should spend the money on a tax enumerator. This issue was referred to the municipal committee for advisement. Mayor’s Report and Police Report: Mayor's report was presented by Mayor Clawson. The Mayor also praised the work of our road crews. Mayor Clawson reminded residents that work on the Route 403 bridge is beginning and ask for extra caution in this area. The Mayor also read a letter from the American Red Cross and name March 2010 as Red Cross Month. Manager’s Report: Borough Manager Rob Barto reported that snow removal efforts during the February storms cost the Borough $11,781. We have applied to the PA Emergency Management Agency for financial assistance. Manager Barto also reported that he is currently working on two projects for Clymer Borough. Parks Development Project this proposal is due to be submitted late April. Also the Downtown development project. Manager Barto will have more on this project in the next month or two.

Finance Committee – John Buterbaugh, Chairman nothing to report Municipal Committee: - Vernon Felton Chairman Councilman Felton made a motion that William Cochran be appointed as Emergency Management Director for Clymer Borough. Clymer is part of a Regional Emergency Management Plan that also includes Cherryhill and Pine townships. Councilman Paulina seconded the motion. Motion carried by roll call vote 6-0 Police Committee: - Joseph Krolick, Chairman nothing to report Property Committee: - Louis Tate, Chairman Councilman Tate made a motion that Council pass Ordinance #333. This Ordinance prohibits parking on lawns for extended periods of time. Permits will be issued by the Borough for residents that wish to construct a permanent parking area on their properties. Motion was seconded by Joseph Krolick. Motion carried by roll call vote 6-0 Councilman Tate also wanted to remind residents that Borough is still taking recyclable items during the winter months. Residents that have large items that they need to dispose of may call Waste Management and make arrangements for pick up of that item. The cost is $10 and they may use a credit card. Parks and Recreation Committee: - John Hughmanic, Chairman It was stated that the new fence around Sherman Street Park was damaged by snow plows. We do have no way of knowing who pushed the snow against the fence. Only permitted contractors should be plowing snow in Clymer Borough. Street Committee: Mike Paulina, Chairman Councilman Paulina read a card received from a local church thanking the Borough for their snow removal efforts during the February storm. Spring clean up has been set for April 27th thru May 1st. Dumpsters will be provided at the Adams Street Maintenance building. We will have the Gazette post another reminder closer to that date. Public Participation: Richard Rainey of Walcott Street says his home was robbed six times this year and he had to call State Police. This matter was turned over to Mayor Dennis Clawson and Chief Douglas for investigation. William Cochran, Emergency Management Coordinator presented the new plan to council on how Cherryhill, Clymer Borough and Pine Township will respond to emergencies. The plan will need signed before being presented to the county. Chris Bracken, a Boy Scout from Troop 13 , would like to make the baseball field at the Sherman Street Park his Eagle Scout project. He would put a protective pipe on the top of the outfield fence, repaint the dugout and pad the backstop support beams. Council granted him approval and requested he contact Rob Barto, Borough Manager and Jody Pearce, Borough Maintenance for any help he might need. Steve Buterbaugh issued a complaint about youth at Sherman Street Park cursing during his recent visit. Chief Douglas will monitor groups at the park. Anyone caught cursing will be banned from the park. Mayor’s Report and Police Report: Mayor Clawson presented the mayor’s report. Chief Douglas presented the police report. The Mayor reminded residents since the weather has become nice to watch out for the children and maintain a safe driving speed. He also reminded residents that burning is not allowed without a burning permit. Also, bridgework is underway on Route 403, please use caution. A motion was made by Councilman Tate and seconded by Councilman Hughmanic to accept the Mayor's Report and Police Report. Motion passed unanimously 5-0. Manager’s Report: Manager Rob Barto reported on the Clymer Development Initiative Committee meeting held on April 7 and attended by representatives from the County Planning Department. One of the topics was Form Base Zoning. Councilman Tate made a motion to authorize Mgr..Barto to seek funding sources to develop a zoning ordinance. Motion was seconded by John Hughmanic Roll call vote 5-0 Parks Development – The Borough needs develop a master plan for Lee and Sherman Street Parks, so we can apply for development funding. A monument is being erected at the old train station site. The plaque will arrive in about 6 weeks. Manager Barto is working on specifications for a new Garbage Contract. A Special committee was appointed by Vice President Krolick to help with that contract.. The committee consists of Councilman Felton, Councilman Buterbaugh and Councilman Tate. Secretary/Treasurer Shirley Simpson’s hourly pay rate at $10.00 per hour starting on May 1, 2010. Roll call vote 5-0 passed. Police Committee: - Joseph Krolick, Chairman Motion was presented by Councilman Tate and seconded by Councilman Paulina to approve an hourly pay rate increase of $.50 per hour for Chief Douglas as of May 1, 2010. Roll call vote 5-0 passed. Property Committee: - Louis Tate, Chairman Presented a proposal by GAI to prepare a master plan for Sherman & Lee Street Parks at a cost of $3000. We would then have all the detail needed to apply next year for funding. The proposal was sent to committee until next meeting. A motion was made by Councilman Tate to grant the use of the vacant Adams Street property behind the Moose Lodge for parking during ball games while roadwork continues on Route 403 and to allow the Fire Department to use this area for their events this summer. Public Participation: Karen Torrell, Steve Karadus and Thomas Torrell of Torrell's Auto Sales – Ask the Borough to pave Hines Street in front of their business. Councilman Paulina said they would look into it however due to the cost of paving, tar and chipping might need to be considered. The Torrell's were also concerned about speeding traffic in front and around their business. They ask about installing speed humps. The paving and speeding matters were referred to Councilman Paulina's Street Committee for resolution. Lawrence Patterson of Dixon Road is concerned that a few residents are illegally transporting their garbage. Chief Douglas will look into this matter. Mayor's & Police reports – The Mayor's report was presented by Mayor Clawson. The Police report was presented by Chief Douglas. Mayor Clawson reported on the Town hall Meeting attended by Vice President Krolick, Councilman Hughmanic and himself. It was conducted by State Senator Don White. Mayor Clawson also cautioned parents that people, especially children, riding bicycles after dark must have their bicycles properly equipped with lights and reflectors, so they are visible to motorists. Mayor Clawson invited the community to attend Memorial Day Services on May 31st in front of the American Legion on Franklin Street. Services will be at 11:00 AM. All are welcome and refreshments will be available after the service. A motion was made by Councilman Paulina and seconded by Councilman Felton to accept the Mayor's Report and Police Report. Motion passed unanimously 5-0. Manager’s Report: Manager Barto reported that the Railroad Station Memorial is nearing completion. Our plaque will be delivered in a few weeks. A dedication of the memorial has been scheduled for July 13th at 6:00 P.M. prior to the regular council meeting. Manager Barto, Jody Pearce, and Chief Douglas are working on a list of items that the Borough would like to submit for “2010 Stimulus Vehicle & Equipment Assistance Project” funding. Manager Barto will present this list at the May 25th Committee meeting for discussion. He intends to make application for funding in June.
COMMITTEE REPORTS
Finance Committee – John Buterbaugh, Chairman Workers Compensation Insurance was quoted for May 2010 through May 2011. AmeriHealth Insurance submitted the low quote and will save us approximately $3000 of our budgeted dollars. H.A. Thomson would still be our insurance broker. All coverage will remain the same. A motion was made by Councilman Buterbaugh to accept the quote of $8,861 from AmeriHealth for the 2010-2011 term. Motion was seconded by Councilman Felton. Passed Roll Call vote 5-0. Municipal Committee: - Vernon Felton, Chairman 2010 Spring Clean up was a success, four, 30 yard dumpsters containing over 20 tons of waste was collected. A motion to adopt a FEMA resolution appointing Manager Rob Barto as Agent for FEMA Disaster Relief Funds relative to the February snow emergency was made by Councilman Felton and seconded by Councilman Hughmanic. Motion passed roll call vote 5-0. Motion was made by Councilman Felton designating July 9th, 10th & 11th and September 24th, 25th and 26th as Clymer Community Yard Sale days. No payment to have a yard sale on these dates is needed by residents, however all other Borough rules pertaining to yard sales do apply. Motion was seconded by Councilman Paulina. Motion passed 5-0 vote. Police Committee: - Joseph Krolick, Chairman – nothing to report Property Committee: - Louis Tate, Chairman (excused absence) Manager Barto reported The proposal by GAI to layout Sherman & Lee Street Ball Parks at a cost of $3000 is still pending. We are waiting to hear back from a few residents. This proposal will be discussed in committee. Parks and Recreation Committee: - John Hughmanic, Chairman Sample Run restroom is out of order. Jody is working with Steve Koches to get a plumber in to assess the problem. Street Committee: Mike Paulina, Chairman Street sweeping will begin this week as weather permits. We are currently working on drainage problems. We will tar and chipping some of the alleys this summer. Manager Barto has approved 20-25 hrs per week for an extra person to help with maintenance for the summer. Public Participation: Jim Douglas -The Borough needs to do a better job of keeping their properties mowed this summer. Mayor Dennis Clawson reminded him that the park in question is considered undeveloped property and does not fall under the same ordinances as property in residential areas or parks that are in use. Councilman Paulina stated that we will be getting help soon and the mowing will be caught up. Imogene Mantini also had a similar complaint near her property, however the mowing was completed today. She also stated that the Borough has rocks that need moved out of that area and deep ruts that need filled in. Councilman Paulina will take action to get this area cleaned up as soon as possible. Mayor's & Police reports – Mayor's Report was presented by Mayor Clawson. No police report was available for the meeting. Manager’s Report: Manager Barto reported that Indiana County Action Program is now accepting applications for the home weatherization program that insulates homes of lower income families at no cost. Information is available on the Borough bulletin board. The only bridge the Department of Transportation will be able to complete this year is the one over Dixon Run. Projects were held up because utilities had to be moved. Bridge work will continue through 2011. COMMITTEE REPORTS
Finance Committee – John Buterbaugh, Chairman Motion was made by Councilman Buterbaugh for Manager Barto to fill out the application for the USDA grants and get quotes for the new vehicles and equipment discussed. Parks and Recreation Committee: - John Hughmanic, Chairman Manager Barto reported that the Pine Grove prisoners have been working to clear the creek banks near the Sherman Street Park and also boarding up big old windows at the Adams street garage. They are not finished to date. This is really a good program for the Borough. Street Committee: Mike Paulina, Chairman Councilman Paulina read a letter of appreciation from Arin School for Jody Pearce's work with Special Needs Students. Councilman Paulina also presented Clymer Borough's maintenance work schedule for the summer. It was stated by Manager Barto that we have a lot of work coming up this summer. Career Track will be providing some students to help, plus we will talk about adding another part time worker. Correspondence/Conferences/Meetings: It was reported that prior to the meeting of July 13th a dedication will be held for the Train Station Monument at 6:00 at the monument site. Chief Joseph Douglas Member Excused Absence – James Marsh, President, CouncilmanVernon Felton Vice President Joseph Krolick called the meeting to order at 7:00 pm and conducted the Pledge of Allegiance, followed by a moment of silence. Approval of the Agenda: A motion to approve the Agenda was made by Councilman Tate, seconded by Councilman Hughmanic Motion passed 5-0 Roll Call Vote Minutes of the Previous Meeting: A motion was made by Councilman Tate, seconded by Councilman Buterbaugh to approve the minutes of the previous meeting. Motion passed 5-0 Roll Call Vote Approval of Fund Balance Report: A motion was made by Councilman Tate, seconded by Councilman Hughmanic to approve the Fund Balance Report. Roll call vote passed 5-0 Presentation of Bills: A motion was made by Councilman Buterbaugh and seconded by Councilman Tate to authorize payment of bills. Roll call vote passed 5-0. Public Participation: John Gromley, President of Clymer Fire Department and Assistant EMA Coordinator for Clymer Borough Clymer is hosting the Fire Assoc. Convention in August. John asked for an exemption from the open container ordinance so that alcohol could be consumed at the convention campsites and the fire hall. The Fire Department is arranging for security to do patrols during this period. A motion was made by Councilman Tate and seconded by Councilman Hughmanic to grant an exemption from our open container ordinance during the convention for both the campsite area and the fire hall with twenty four hour security furnished by the Fire Department. The motion passed roll call vote 5-0 John also ask Council to approve Halloween trick or treating and parade in the Borough on Saturday October 30th. Halloween activities will follow the same schedule as 2009. Details will be published this fall. Permission was granted by Council acting President Krolick. John also wanted to thank Council and everyone at Clymer Borough who helped with Emergency Management in February during record breaking snow falls. Joann Shedlock owner of Shedlock's Day Care and several other parents addressed council regarding a traffic issue at Third and Sherman Street affecting the safety of children arriving and leaving her day care center. She stated that pedestrian cross walk signs which were temporarily placed near the intersection slowed traffic however the signs have been removed. Ms. Shedlock requested they be re-placed to slow traffic and possibly save lives. Mayor Clawson said he is of the opinion the signs only worked about half the time and he received many complaints about the signs from residents and motorists. He told the Shedlock group he would be presenting a recommendation to Council this evening regarding the issue. Shedlock indicated she was aware of a recommendation which might include a loading zone alongside her property as a solution. She said the problem is being caused by drivers not the parents and any other solution would not be to their liking. Mayor's & Police reports – Mayor's Report was presented by Mayor Clawson. No police report was available for the meeting. Motion was made by Councilman Tate and Councilman Hughmanic to accept report as read. Motion passed unanimously 5-0. Mayor Clawson presented his proposal to Council to resolve the traffic problem at Third and Sherman Streets. He suggested making 80 feet of Third Street in front of the Shedlock Day Care a no parking, loading and unloading zone. Parents would pull into the zone and load and unload from the passenger side of their cars with the doors facing the Day Care rather than the street. The proposal by Mayor Clawson was referred to committee for further action.
Manager’s Report: Rob Barto Manager He reported he is working with the DT Development Committee on “Land Use Planning”. Manager Barto was appointed to the County Solid Waste Advisory Committee. This committee is working on long range plans to manage and reduce waste through recycling in each community. Rob reported on the County Pedestrian-Bicycle Transportation Planning Committee meeting. During the recent planning meeting, the George Clymer Trail was added to the county's trail map and the Committee has recommended extending this trail to Dixonville, a distance of approximately four miles. Manager Barto reported that the grant application to the USDA for vehicles and equipment has been submitted. The amount of the project is $251,963 and the borough will have to come up with 25 % or $62.991. Selling surplus equipment would raise approximately $40,842 of that amount. Response to the grant application should be received in approximately one month. COMMITTEE REPORTS Finance Committee – John Buterbaugh, Chairman nothing to report Municipal Committee: - Vernon Felton , Chairman (absent) Rob Barto, Borough Manager reported the Borough’s contract with Waste Management is up at the end of the year. The committee will be meeting in the near future to start working on bids specifications. Police Committee: - Joseph Krolick, Chairman Councilman Hughmanic inquired about increasing the parking meter fines and checking for parking violators more often in order to get our police revenues up. Mayor Clawson said we are currently monitoring speeders and stop sign violators. The police department will continue to check parking meters as often as possible. Property Committee: - Louis Tate, Chairman The Borough has submitted the Flood Plain Ordinance to DCED and received two comments. Action will need to be taken on these items during the August meeting. 1. Section 3.01, an actual position needs to be designated for the Floodplain Administrator. 2. There is a section of the current ordinance that prohibits certain business and facilities in the flood zone. The recommended ordinance does not address this issue. Council is of the opinion to leave the recommended ordinance “as is”. Parks and Recreation Committee: - John Hughmanic, Chairman A key for the pavilion area will be placed in Councilman Hughmanic's mailbox so he can access the park as necessary. Councilman Hughmanic proposed increasing the rental price of the large pavilion for 2011 from $50 to $75. The small pavilion will stay at $50.00. Anyone who has already reserved for next year will receive the 2010 price. A motion was made by Councilman Paulina and seconded by Councilman Hughmanic to increase the cost of the large pavilion from $50 to $75 for 2011. Roll call vote passed 5-0. Councilman Hughmanic also stated that he had an excess of $1000 in his 2010 budget and he would like to donate it to the Street committee. Street Committee Chairman, Councilman Paulina stated the $1000 will be put to good use.
Street Committee: Mike Paulina, Chairman Borough Manger Barto and Jody Pearce interviewed Shaun Krouse for temporary summer help for maintenance and would like to have Council ratify action to hire. Councilman Paulina made a motion to hire Shaun Krouse for temporary summer help for borough maintenance at $8.00 hour. Motion was seconded by Councilman Tate and passed roll call vote 5-0. Mayor Clawson stated that the Clymer Days committee asked for the Borough’s help in setting up and tearing down at the September event. Councilman Paulina made a motion that Borough Maintenance give Clymer Days Committee the help that they need. Motion was seconded by Councilman Hughmanic. Passed vote 5-0.
